Welcome to Lavender Union, operated by Magus Labs LLC (“we,” “us,” “our”). By creating an account or using our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not create an account or use Lavender Union.
1. Definitions
- “Service” means the Lavender Union web and mobile applications, any related websites (including lavenderunion.com), APIs, and associated services we operate.
- “User” refers to any individual accessing the Service, whether as a Free User or Premium User.
- “Content” means any text, images, videos, audio clips, graphics, or other media uploaded, transmitted, or otherwise provided through the Service.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that all information you provide is truthful, accurate, and current.
3. Account Management
- Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You may not share your account with others.
- Account Deactivation: You may deactivate your account at any time. Your profile will be hidden, and your data will be retained for a 90-day period to allow for reactivation. After 90 days, all your data will be permanently deleted.
- Account Deletion due to Inactivity: To protect user privacy, accounts that remain inactive are subject to deletion. Free User accounts inactive for 180 consecutive days will be permanently deleted. For Premium User accounts, this period is extended to 365 days of inactivity. Deletion includes all Content and any associated Premium membership.
4. Premium Membership
- Plans: Lavender Union offers two premium plans: a recurring Monthly subscription and a recurring Annual subscription, purchased in the Android app and billed and managed by Google Play. Premium applies to your account wherever you log in. Founding members may receive a free Premium period that ends automatically.
- Benefits: Premium benefits are subject to change but currently include: unlimited daily likes, the ability to see who has liked your profile, unlimited messaging with matches, expanded media slots for photos and videos, the ability to upload one audio clip to your profile, and three (3) profile boosts per month, and an ad-free experience in the Android app.
- Boosts: Unused profile boosts do not roll over to the next month.
- Subscriptions: Subscriptions renew automatically at the end of each monthly or annual period until cancelled. You can cancel at any time in Google Play; Premium stays active until the end of the period you have paid for.
- Forfeiture: If your account is deleted by you or terminated by us for violations of these Terms, any active Premium membership is forfeited without refund.
5. Payments & Refunds
All payments are processed through third-party payment providers. Refunds may be granted on a case-by-case basis but generally will not be issued if you have used the Premium service for more than 7 days.
6. User Conduct & Content Restrictions
You agree to use the Service in a lawful and respectful manner. You are solely responsible for the Content you post. You agree not to:
- Harass, threaten, defraud, or harm another person.
- Impersonate any person or entity.
- Upload or distribute malicious code or viruses.
- Engage in data scraping, automated account creation, or attempts to bypass our security measures.
- Use the Service to arrange any marriage or partnership for an unlawful purpose, including immigration or benefits fraud.
Furthermore, you may not post, upload, or share any Content that:
- Is sexually explicit, pornographic, or depicts graphic violence.
- Promotes hate speech, discrimination, racism, or bigotry against any individual or group.
- Is illegal, defamatory, obscene, or otherwise objectionable.
- Constitutes spam, commercial advertising, or solicitation for other services.
- Infringes on any third party's rights, including copyright, trademark, or privacy. This includes posting audio clips of copyrighted music or other intellectual property you do not have the right to share.
- Contains the private information of any other person without their explicit consent.
Violation of these content restrictions may result in immediate Content removal, account suspension, or permanent termination without refund.
7. Content Ownership & License
You retain ownership of the Content you post. By posting Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your Content as part of providing the Service.
8. Privacy
We will never sell your personal information. Please review our Privacy Policy for full details on how we collect and use your data.
9. Termination
We may suspend or terminate your account at any time, without notice, if you violate these Terms.
10. Disclaimer & Limitation of Liability
The Service is provided “as is” without warranties of any kind. We are not responsible for the conduct of any user, on or offline. Lavender Union does not provide legal, financial, or immigration advice. Our liability is limited to the amount you paid to us in the 12 months preceding any claim.
11. Dispute Resolution & Arbitration
Any dispute arising under these Terms will be resolved through binding, individual arbitration and will be governed by the laws of the State of Maryland.
12. Changes to These Terms
We may modify these Terms at any time. If changes are material, we will notify you before they take effect. Continued use of the Service constitutes acceptance of the new Terms.
